Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

This is an application for grant of anticipatory bail in connection with Kudhani PS case no. 840 of 2021, registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code.

The learned counsel for the petitioner, at the outset, seeks to withdraw the present petition, however with liberty to the petitioner to surrender before the learned court below within a period of four weeks from today and apply for regular bail, nonetheless, seeks a direction upon the learned court of Additional Chief Judicial Magistrate-1st (West), Muzaffarpur in connection with Kudhani PS case no. 840 of 2021 to consider and dispose of the regular bail petition, to be filed by the

Patna High Court CR. MISC. No.31344 of 2023(2) dt.14-07-2023 2/2 petitioner, on the same day, considering the fact that the present case has arisen on account of land dispute and the petitioner is having a clean antecedent.

Having regard to the facts and circumstances of the case, I deem it fit and proper to dispose off the present petition as not pressed, however, in case the petitioner surrenders before the learned court of Additional Chief Judicial Magistrate-1st (West), Muzaffarpur in connection with Kudhani PS case no. 840 of 2021, within a period of four weeks from today and files appropriate petition for grant of bail, the same shall be heard and disposed off on the very same day, considering the aforesaid submissions of the learned counsel for the petitioner.
