2. The petitioner has preferred this application for grant of regular bail in connection with Yogapatti P.S. Case No. 356 of 2023 registered for the offence punishable under Section 302/34 of the Indian Penal Code.

3. As per the prosecution case, the son of the informant went out to play, but did not return. The informant lastly saw his son going along with co-accused Ram Chhatri Yadav on his motorcycle. The next morning, the dead body of the informant's son was recovered. The informant suspected that all the FIR named accused persons including the petitioner have committed the murder of his son.

4. Learned counsel for the petitioner has submitted

It has further been submitted that neither the informant nor anyone else is the eye witness of the alleged offence of murder and except suspicion there is nothing against the petitioner. It has further been submitted that no overt act has been alleged against the petitioner and the allegation of last seen is not true. It has further been submitted that there are no materials against the petitioner except a bald suspicion on the basis of land dispute. It has further been submitted that coaccused Guddu Yadav @ Guddu Kumar Yadav has been granted the privilege of bail by order dated 16.04.2025 passed in Cr. Misc. No.

20418 of 2025 as well as co-accused persons Dhandhar Yadav and Shiv Shankar Yadav have also beeen extended the privilege of bail by a Coordinate Bench of this Court by order dated 21.03.2024 passed in Cr. Misc. Nos. 3617 of 2024 and 6475 of 2024 respectively. It has further been submitted that chargesheet has been filed against the petitioner and there is no allegation of tampering against him. Lastly, it has been submitted that the petitioner has got no criminal antecedent and he is in custody since 24.02.2026.

5. Learned APP for the State has vehemently opposed the prayer for bail of the petitioner.

6. Heard the parties and perused the record.

7. Considering the facts and circumstances of the case, let the petitioner above-named, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Bettiah, West Champaran, in connection with Yogapatti P.S. Case No. 356 of 2023.

8. The application stands allowed.
