2. The petitioner seeks bail, who is in custody since 21.11.2025 in connection with Amdabad P.S. Case No. 289 of 2025, FIR dated 20.11.2025 registered for the offence under Section 103(1) and 3(5) of the Bharatiya Nyay Sanhita, 2023.

3. Allegation against the petitioner is that he assaulted the brother of the informant with iron rod and due to which informant's brother sustained injury and later on died during treatment.

4. Learned counsel appearing for the petitioner submits that the petitioner has clean antecedent and he has falsely been made implicated in this case. He further submits

No.29503 of 2026(2) dt.04-05-2026 2/2 that the allegation as alleged in the F.I.R. is false and fabricated and the petitioner has not committed any offences as alleged in the F.I.R. He next submits that police has submitted chargesheet against the petitioner and the petitioner is rotting in judicial custody since 21.11.2025.

Learned A.P.P. for the State, on the other hand, has vehemently opposed the prayer for bail of the petitioner and submits that there is direct and specific allegation against the petitioner that he assaulted the brother of the informant by means of iron rod due to which brother of the informant sustained injury and later on died. He next submits that the allegation levelled against the petitioner is also supported by the medical evidence (post-mortem report).

6. Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail in connection with Amdabad P.S. Case No. 289 of 2025, pending in the Court of Judicial Magistrate, 1st Class, Katihari.

7. Prayer is refused.
