This application for anticipatory bail has been filed by the petitioner, who apprehends his arrest in connection with Parwalpur P.S. Case No. 191 of 2018 registered for offence under Sections 420, 467, 468, 414, 401 and 34 of the Indian Penal Code.

As per the allegation in the FIR, it is stated that while the police personnel were checking the vehicles on road, on seeing the police personnel, the accused persons had tried to flee away. Two persons were caught while the third person managed to escape. It was stated by one of the apprehended persons that they were involved in committing theft and selling of stolen motorcycle. The petitioner was going to facilitate to sell the said stolen motorcycle.

It is submitted by the learned counsel for the

Patna High Court CR. MISC. No.34887 of 2019(2) dt.29-05-2019 2/2 petitioner that the petitioner was not caught at the place of occurrence and has no connection with the stolen motorcycle and his name transpired on the so called confession of one of the accused.

The application for bail has been opposed by learned A.P.P. for the State.

Having heard the learned counsel for the parties and taking into consideration the facts that the name of the petitioner transpired on confession of one of the accused, that the petitioner was not caught at the spot and that he has no criminal antecedent, the petitioner, above named, in the event of his arrest or surrender in the court below within a period of six weeks from today in connection with Parwalpur P.S. Case No. 191 of 2018 be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st, Hilsa, Nalanda, subject to the conditions as laid down under Section 438(2) of Cr.P.C.
