====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 19-08-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 376 of the Indian Penal Code.

Allegation against the petitioner is that taking advantage of loneliness of informant, he committed rape against her. Subsequently, he promised to marry with the informant. The statement of the victim-girl recorded under Section 164 Cr.P.C. reveals that the petitioner was the rapist. Learned counsel for the petitioner submits that the petitioner is not ready to marry.

Patna High Court Cr.Misc. No.33240 of 2017 (2) dt.19-08-2017 2/2 Considering the nature of allegation, I am not inclined to grant anticipatory bail to the petitioner in connection with Mahila Police Station Case No. 70 of 2017 pending in the court of learned Sub-Divisional Judicial Magistrate, Nalanda at Biharsharif.

Hence, prayer for bail is refused.
