Petitioner apprehends arrest in connection with Siwaipatti P.S. Case No. 139 of 2017 registered for the offence punishable under sections 302, 120B/34 of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case merely on suspicion. The matter has been compromised between the parties vide Annexure-2. Petitioner is a man of clean antecedent and is in custody since 07.12.2018. Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that petitioner is

Patna High Court CR. MISC. No.28902 of 2019(4) dt.09-07-2019 2/2 named accused in the first information report and there is specific allegation levelled against him. During investigation, witness have supported the prosecution case.

Considering the nature of allegations levelled, the materials available on record and the submissions advanced on behalf of the parties, this Court does not find it to be a fit case for grant of bail to the petitioner. The same is, therefore, rejected.

However, petitioner may renew his prayer for bail after framing of charge.
