The petitioner apprehends his arrest in a case in connection with Banka P.S. Case No.151/2018 registered for the offence punishable under Sections 419/420/120(B) of the Indian Penal Code and section 6/10 of Bihar Examination Control Act. The allegation against the petitioner is that one other person was caught appearing in the examination in place of the petitioner.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. No such occurrence as alleged ever took place. The petitioner has left the native village in January 2018 itself and had dropped the idea to appear in the exam. He has no connection with the person taking

Patna High Court CR. MISC. No.29577 of 2020(5) dt.19-03-2021 2/2 exam in his place. He has no criminal antecedent and the person appearing in his place has already been granted bail. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending in connection with Banka P.S. Case No.151/2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
