2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 419, 420, 465, 466, 471 and 120(B) of the Indian Penal Code (in short 'IPC').
3. The case of the prosecution is that while the informant was investigating Marhowrah P.S. Case No. 53 of 2024, he came to know that false case has been filed on the basis of forged injury.
4. Learned counsel for the petitioner submits that petitioner is only a witness in that case. He has also submitted that Babita Devi who was the informant in Marhowrah P.S. Case No. 53 of 2024 has been given benefit of Section 35 of the BNSS. It has also been submitted by the learned counsel that the petitioner
Patna High Court CR. MISC. No.30166 of 2025(2) dt.19-05-2025 2/2 is having criminal antecedent of 8 cases in which he is bail in all the cases. The petitioner is in custody since 08.02.2025.
5. Learned APP appearing for the state has opposed the prayer of regular bail. He submits that the petitioner is having criminal antecedent of 8 cases.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Marhowrah P.S. Case No. 526 of 2024 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra.
