The petitioner, in the present case, is seeking setting aside the order dated 08.07.2020 passed in Cr. Appeal No. 07 of 2020 arising out of Amarpur P.S. Case No. 132 of 2020 registered for the offence under Section 399, 402 of the Indian Penal Code and 25(1-B)A/26/35 of the Arms Act, passed by learned Additional Sessions Judge - 1st, Banka. Earlier this court vide it's order dated 16.10.2020 granted provisional bail to the petitioner.
Learned counsel for the petitioner submits that on the alleged date of occurrence the petitioner was 16 years 8 months old, he had got no criminal antecedent and he is presently in the Observation Home since 05.03.2020.

After perusal of the same and upon noticing that the petitioner had no criminal antecedent, he interacted with the Probation Officer like any other simple boy and the homely environment of the house of the petitioner is cordial, this Court is of the considered opinion that stay with the family will be in his interest both mentally and emotionally. The father of the petitioner has already been directed to give an undertaking that he will take care of the education of the petitioner and shall not allow him to fall in bad company, therefore, this Court confirms the provisional bail granted to the petitioner vide order dated 16.10.2020.
The Child Probation Officer shall keep on visiting the residence of the petitioner and will submit the periodical statements in this regard to the learned Juvenile Justice Board, Banka.
