Petitioner apprehends his arrest in connection with Ladania P.S.Case No. 32 of 2018 registered for the offences punishable under Section 7 of Essential Commodities Act. Allegation is that one pickup van loaded with rice was apprehended and driver of the vehicle disclosed that rice was picked up from PDS shop of the petitioner.
Submission of learned counsel for the petitioner is that FIR itself shows that there is no shortage of rice in the PDS shop of the petitioner and petitioner was not present there as he has gone to see his daughter, who was being treated in Appolo Burn Hospital, Patna and he has nothing to do with the seized rice. Heard learned APP also.

No.48162 of 2018 (2) dt.23-08-2018 2/2 Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, named above, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhubani, in connection with Ladania P.S.Case No. 32 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
