JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 03-02-2021 As prayed for, let the learned counsel for the petitioner remove the defect(s), as pointed out by the office vide its notes dated 25.11.2020, within four weeks of starting of the Court proceeding in physical mode.

Heard the parties.

The petitioner seeks bail in connection with Bodh Gaya (Cherki) P.S. Case No.532 of 2018 registered under Sections 302/34 of the Indian Penal Code besides Section 27 of the Arms Act, pending in the court of the Chief Judicial Magistrate, Gaya.

Earlier, the prayer of the petitioner for grant of bail was rejected by this Court vide order dated 11.12.2019 passed in Criminal Misc. No.47760 of 2019 on merit, taking into

Patna High Court CR. MISC. No.31801 of 2020(2) dt.03-02-2021 2/2 consideration that out of the three assailants of the deceased, the petitioner was also one of them, who caused firearm injury to the deceased through firearms.

Learned Senior counsel for the petitioner submits that the petitioner is in custody since 28.03.2019. Having regard to the facts and the circumstances of the case and the nature of allegation against the petitioner, I am not inclined to reconsider the prayer of the petitioner for grant of bail. Accordingly, the prayer of the petitioner for grant of bail stands rejected.
