Petitioner is apprehending his arrest in Bakhtiyarpur P.S.Case No.474 of 2017 registered for the offences under Sections 147, 148, 149, 341, 323, 447, 379, 307, 504, 506, 386 and 387 of Indian Penal Code.
Allegation against the petitioner and others is of demand of rangdari and also of snatching Rs.5000/- from the pocket of the informant. Further allegation is that the petitioner is accused in four other cases.
Submission of the learned counsel for the petitioner is that no specific allegation has been attributed to him and allegation of snatching of Rs.5000/- is ornamental in nature. Though the petitioner has got criminal antecedent but all the cases
Patna High Court Cr.Misc. No.48224 of 2018 (2) dt.23-08-2018 2/2 are of land dispute.
Heard learned A.P.P. also.
Having heard both sides and in view of the nature of allegation and also criminal antecedent, I am not inclined to grant the privilege of anticipatory bail to the petitioner, rather the petitioner may surrender before the learned court below and pray for regular bail which will be considered by the learned court below on its own merit without being prejudiced by this order. With the aforesaid observation, this application is dismissed.
