The petitioner is apprehending his arrest in connection with Noorsarai P.S.Case No.77 of 2016 registered for offences punishable under Sections 419 and 420 of the IPC and Section 10 of the Bihar Conduct of Examination Act, 1981. Allegation against the petitioner is that he was appearing in place of another candidate in the examination and he was also released on police bail.
Submission of the learned counsel for the petitioner is that he has not misused the privilege of police bail and now the chargesheet has been submitted against him. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and
Patna High Court Cr.Misc. No.46031 of 2018 (2) dt.09-08-2018 2/2 circumstances, as stated above, I am not inclined to grant anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below on the submission that he has not misused the privilege of police bail granted to him and will try to dispose of the same if possible on the dame day.
With the aforesaid observation, this application is disposed of.
