Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State and also heard the learned counsel for the informant.

The petitioner apprehends his arrest in connection with Raxaul (Haraiya OP) P.S. Case No. 109 of 2022 registered for offence punishable under sections 341, 323, 354, 354A, 354B, 354D of the Indian Penal Code.

The petitioner is the father of the informant. The informant made allegation that on the occasion of Holi, her

The learned counsel for the petitioner has submitted that the petitioner is the father and he is not expected to do such kind of act with his own daughter. He has submitted further that the case has been compromised and the victim is residing in the same house with her father.

The learned counsel for the informant has submitted that she has compromised the case.

Considering the above-mentioned facts and circumstances, the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Raxaul, East Champaran, Motihari in connection with Raxaul (Haraiya OP) P.S. Case No. 109 of 2022, subject to condition as laid down under section 438(2) Cr. P.C. Further condition is that if similar incident is reported against the petitioner, the learned court below will be at liberty to cancel his bail bonds.

Patna High Court CR. MISC. No.31025 of 2022(4) dt.12-01-2023 3/3 Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
