The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 379, 411, 188 of the Indian Penal Code and section 11/41/56(2) of the Bihar Minerals (Concession, Prevention of Illegal Mining, Transportation & Storage) Rule, 2019 and sections 4(1), 21 of the Mines and Minerals (Development and Regulation) Act.

3. As per the prosecution case, petitioner is the owner of seized truck which was loaded with illegal sand.

4. It is submitted that petitioner is ready to pay the revenue loss caused to the government at the time of furnishing bail bond through Demand Draft. Petitioner claims clean

Considering the fact that petitioner is ready to pay the revenue loss caused to the government, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Banka P.S. Case No. 52 of 2023, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure with further condition that petitioner will pay the amount which was caused as revenue loss to the government at the time of furnishing bail bond through Demand Draft.
