Learned counsel for the respondent no. 2 informed this Court that in the present case cognizance has been taken against the appellant, therefore, in view of ratio laid down by the Hon'ble Apex Court in the case Bachu Das vs. State of Bihar reported in (2014) 3 SCC 471, this application is not maintainable.

4. Considering the above-mentioned facts, this application stands dismissed.
