Petitioner seeks regular bail in connection with Chainpur P.S. Case No. 397 of 2019, Gr. No. 2391 of 2019 registered for the offence under Section 420 , 409 of the I.P.C. As per the allegation the petitioner misappropriated a sum of Rs. 462676 /- which was meant for the construction of the school building .

Learned counsel for the petitioner submits that petitioner is the In-charge Headmaster of the school and has falsely been implicated in this case merely because there was delay in construction work and now the work has already been completed which would be evident from Annexure 2 i.e. a letter issued by the District Programme Officer, Kaimur at Bhabua addressed to the BEO, Chainpur stating therein that petitioner has completed the work of construction of building of the school. Learned counsel further submits that BEO, Chainpur, Kaimur, who is the informant has written a letter to the Additional Chief Judicial Magistrate- II, Kaimur at Bhabua

Patna High Court CR. MISC. No.40440 of 2021(2) dt.27-01-2022 2/2 informing him about completion of school building by the petitioner with a request to drop the charges as against the petitioner. The petitioner is in custody since 2nd April 2021. Regard being had to the submissions made by the parties and taking into consideration the materials available on record, the fact that vide Annexure -2 to the bail application the District Programme Officer, Kaimur (Bhabua) has confirmed the completion of the work of school building by the petitioner and the petitioner is in custody since 2 / 4 / 2021 and charge sheet has already been submitted, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 25000/- ( twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II, Kaimur at Bhabua in connection with Chainpur P.S. Case No. 397 of 2019, Gr. No. 2391 of 2019.
