2. Petitioner seeks bail who is in custody since 07.02.2026 in connection with Vigilance P.S. Case No. 15 of 2026, F.I.R. dated 05.02.2026 for the offences punishable under Sections 7(a), 7(c) and 12 of the Prevention of Corruption Act, 1988 (amended 2018) and Section 61(2) of the BNS, 2023.

3. According to prosecution case, this petitioner has demanded Rs. 5 lakhs from the informant as a bribe.

4. Learned counsel for the petitioner submits that petitioner has clean antecedent and he has falsely been

He further submits that as per the allegation in the FIR the petitioner has demanded bribe of Rs. 5 lakhs from the informant and he was caught red handed with the said amount in the vehicle in question and the same was matched with the pre-trap memorandum and post-trap memorandum. He further submits that no such occurrence has taken place. He further submits that the Vigilance after investigation submitted the charge sheet against the petitioner on 03.04.2026 and the petitioner is in custody since 07.02.2026 and after filing of the charge sheet, the petitioner is no more required by the prosecution agency and the petitioner is ready to co-operate in the trial.

5. The learned Spl.P.P. for the Vigilance has vehemently opposed the prayer for bail of the petitioner.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Vigilance, Patna in connection with Vigilance P.S. Case No. 15 of 2026, subject to the following conditions:- i. Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court

No.29602 of 2026(3) dt.12-05-2026 3/3 and shall remain physically present as directed by the court and on his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the Court below. ii. If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.

iii. And further condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
