Petitioner is in custody in connection with Pipra P.S. Case No. 51 of 1986 for the offence under sections 467 and 468 of the Indian Penal Code.

Learned counsel for the petitioner would submit that petitioner was granted bail on merit having regard to the fact that petitioner has no criminal antecedent. Howerver, his bail bond was cancelled due to lack of pairvi on 17.1.2019 and thereafter, non bailable warrant was issued and petitioner was arrested on 25.1.2019.

Considering the fact that petitioner was granted bail and after cancellation of bail bond, the petitioner has remained in custody for nearly six months, the the Court is inclined to

No.30609 of 2019(3) dt.17-08-2019 2/2 grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Supaul, in connection with Pipra P.S. Case No. 51 of 1986 subject to the condition that petitioner shall extend full cooperation in conclusion of trial and if the petitioner fails to attend the court proceeding on two consecutive dates without any cogent reason, the court below shall be at liberty to cancel the bail bond of the petitioner.
