Petitioner apprehends his arrest in connection with Riga P.S.Case No. 287 of 2017 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307 of the Indian Penal Code and 27 of the Arms Act.
Allegation as per FIR is that with respect to installation of transformer a dispute arose and it is alleged that petitioner fired, causing injury to the informant.
Submission of learned counsel for the petitioner is that there was scuffle between the parties due to installation of transformer and there is counter case also and several persons from petitioner's side have received grievous injuries. Heard learned APP and learned counsel for the
Patna High Court Cr.Misc. No.48457 of 2018 (2) dt.24-08-2018 2/2 informant. They have opposed the prayer for anticipatory bail stating that there is direct allegation of firing against the petitioner. Having heard both sides and in the facts and circumstances, let the petitioner, named above, surrender within a period of six weeks from the receipt of this order and on his so surrendering he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi, in connection with Riga P.S.Case No. 287 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
