====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 18-01-2021 Heard learned counsel for the petitioners and learned APP for the State.
Petitioners seek bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
For property dispute, petitioner no. 1 Vinod Ram allegedly caused murder of his father, who was brother of the informant. When the informant reached at the place of occurrence, he saw that the petitioner no. 1 was carrying a dagger in his hand and the deceased was lying there in a pool of blood. Petitioner No. 2 Shila Devi, who is wife of petitioner no. 1, was also there at the place of occurrence. Since no overt act is alleged against the petitioner no.

No.29559 of 2020(3) dt.18-01-2021 2/3 2 Shila Devi, let the petitioner no. 2 Shila Devi, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sessions Trial No. 440 of 2019/203 of 2019 arising out of Khudwa Police Station Case No. 37 of 2019, subject to the following conditions:- (a) The petitioner no. 2 shall fully cooperate with the trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner no. 2. (b) Both the bailors shall be resident of territorial jurisdiction of the learned court below.
(c) The petitioner no. 2 shall not leave the country without permission of the learned trial court. Petitioner No. 1 Vinod Ram is in jail since 29.08.2019.
Considering the nature of allegation against petitioner no. 1, I am not inclined to enlarge him on bail for the present in connection with the aforesaid case pending in the Court of learned 13th Additional Sessions Judge, Aurangabad/successor Court.
Hence, prayer of the petitioner no. 1-Vinod Ram for
Patna High Court CR. MISC. No.29559 of 2020(3) dt.18-01-2021 3/3 bail is refused.
Learned Trial Judge is directed to expedite the trial of the case.
