Heard learned Counsel for the petitioner and learned APP for the State.

This application, for grant of anticipatory bail, arises out of Jhanjharpur PS case no. 240 of 2022 dated 21.10.2022, disclosing offences punishable under Section 380 of the Indian Penal Code.

The prosecution story, as per the First Information Report, is that in the intervening night of 19/20.10.2022 at about 12.40 am, while the informant and family members were sleeping, in the meanwhile, petitioner and other accused persons entered into the house of the informant and bolted all the doors of the house from outside.

No.30002 of 2025(2) dt.16-05-2025 2/3 It is alleged that accused persons started taking out petrol from the oil tanker of the motorcycle and co-accused persons namely Prince Kumar Chaudhary and Nehal Kumar Chaudhary started removing battery from the tractor of the informant. when the informant woke up upon noise and tried to get outside of his house but he could not come out due to the fact that the doors were bolted by the accused persons from outside prior to committing the theft. Thereafter, the informant raised alarm and some villagers arrived and caught the petitioner and other accused persons but co-accused Nehal Kumar Chaudhary threatened to kill the villagers and thereafter, all accused persons fled away with petrol and battery worth Rs. 1,25,000/-.

Learned Counsel for the petitioner submits that petitioner has falsely been implicated in this case due to political rivalry in panchayat election. Learned counsel further submits that the petitioner and informant are residents of same village and accordingly, the petitioner has been made accused due to previous rivalry.

Regard being had to the submissions made on behalf of the parties and taking into consideration the nature of allegation and the fact that the petitioner and others were

This application is, accordingly, dismissed.
