The petitioner apprehends his arrest in connection with Jogbani P.S. Case No. 18 of 2018, registered under Section 395 of the Indian Penal Code, pending in the court of Chief Judicial Magistrate, Araria.

Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. but in course of investigation, on the basis of confessional statement of coaccused, Usman @ Fichcha, the name of petitioner has surfaced. Learned counsel for the State vehemently opposed the prayer for bail and submits that while on the basis of written report of informant, Jagrnath Yadav, the present case has been lodged against unknown but informant in his written report

Patna High Court CR. MISC. No.33418 of 2019(2) dt.21-05-2019 2/2 claimed to identify the culprits, who indulged in the present case.

Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
