11-01-2021 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks bail in Ahiyapur P.S. Case No. 1395 of 2019, registered for the offence punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
As per the prosecution case, it is alleged that this petitioner alongwith two other accused persons committed the murder of the informant's husband while he was returning to his house from the Bank.
It is submitted on behalf of petitioner that informant is not eye-witness to the occurrence and only on getting informant, she rushed to the place of occurrence. Save and except suspicion, there is nothing against this petitioner.

No.30025 of 2020(3) dt.11-01-2021 2/2 However, learned A.P.P. for the State has vehemently opposed the bail application and submitted that during investigation, in paragraph - 11 of the case diary, it has come that husband of the informant, while was being taken to hospital, himself informed the informant that petitioner and others, named in the FIR, have shot him.
Considering the nature of allegation and the fact, which has come during course of investigation, the bail application of petitioner stands rejected.
