====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL JUDGMENT Date : 05-08-2025 Heard learned counsel for the petitioner and learned counsel for the State.

2. The present writ application has been filed with the following reliefs:-

1. That this is an application on behalf of the above named petitioner for issuance of an appropriate writ (s), order (s) commanding thereby to the respondent(s) concerned to revise salary of the petitioner after putting him in following pay scale:- (i) Pay scale of Joint Director (Dairy)

Patna High Court CWJC No.713 of 2017 dt.05-08-2025 2/3 class-I (Special category) for the period of 07-032008 to 23-12- 2014. (ii) Pay scale of Director (Dairy) for the period of 24- 12-2014 to 31-05-2016 since in these period he on the higher was posted and discharged duties post but got salary of the lower post.

The petitioner further prays that after revision of his salary, the Respondent (s) concerned be directed to calculate his arrear of salary thus make payment of the same with statutory as well penal interest and also grant all the consequential benefits befitting in the facts and circumstances of the case.

Counsel for the petitioner fairly submits that during pendency of the writ petition, a counter-affidavit has been filed in which it has been intimated that an order has been passed in Memo No.1054 dated 30.03.2017 by which the claim of the petitioner has been rejected. He further submits that the liberty may be granted to the petitioner to challenge the same.

4. In the light of the submissions made, this Court finds that during pendency of the present writ application, an order has been passed vide Memo No.1054 dated 30.03.2017 by the respondent. As such, the present writ application stands disposed off granting liberty to the petitioner to challenge the said order dated 30.03.2017 which is now barrier for the

5. With the aforesaid observations, the present writ application stands disposed off.
