JUSTICE RAJESH KUMAR VERMA ORAL ORDER 04-05-2026 Heard Mr.Dhirendra Prasad Sinha, learned counsel for the petitioner, Mr. Shanti Bhushan Singh, learned counsel for the informant and Mr.Zainul Abedin, learned A.P.P. for the State.
2. The petitioner seeks bail, who is in custody since 23.02.2026 in connection with Jandaha P.S. Case No. 214 of 2025, F.I.R. dated 22.05.2025 registered for the offence punishable under Sections 126(2), 115(2), 118(1), 303(2), 3(5) of the B.N.S. Later on 22.01.2026 Section 103(1) & 109 of B.N.S. were added by I.O.
3. As per F.I.R. Informant namely Suresh Mahto alleged that on 19.05.2025, his son was returning back to home with 1.5 lakh Rupees and in the way five unknown
2/4 persons stopped informant son, assaulted him and also snatched the amount form him.
4. Learned counsel appearing for the petitioner submits that the petitioner has clean antecedent. It appears from the F.I.R. that initially the petitioner was not named in the F.I.R.. The name of the petitioner has been transpired during investigation on the basis of the re-statement of the son of the informant and other persons. On the basis of the aforesaid, name of the petitioner has been transpired during investigation in the present case and the persons, who are named in the FIR, namely Kalu Mahto and others, have been granted privilege of anticipatory bail by a Coordinate Bench of this Hon'ble Court vide order dated 19.03.2026 passed in Cr. Misc. No. 76266 of 2025 and the petitioner is in custody since 23.02.2026.
5. Learned counsel for the informant and learned APP for the State have opposed the prayer for bail of the petitioner.
6. Considering the aforesaid fact, petitioner has clean antecedent, initially the petitioner was not named in the F.I.R. , the name of the petitioner has been transpired during investigation on the basis of the re-statement of the son of the
3/4 informant and the persons, who are named in the FIR, have been granted privilege of anticipatory bail by a Coordinate Bench of this Hon'ble Court, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M, Vaishali at Hajipur, in connection with Jandaha P.S. Case No. 214 of 2025,with the following conditions:- (I) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present as directed by the Court and on his/her absence on two consecutive dates without sufficient reason, his/her bail bond shall be cancelled by the Court below.
(II) If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.
(III) And, further condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage, it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the
4/4 acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
