2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 302 and 34 of the Indian Penal Code.

3. As per the prosecution case, co-accused Kranti Ram assaulted the informant with sharp edged weapon. When the brothers of informant intervened to save him, then he also assaulted them with knife, as a result of which informant and his brothers got severely injured. During course of treatment, brother of informant Kundan Ram died.

4. It is submitted that from perusal of FIR it is apparent that informant is eye-witness of the occurrence and as

Patna High Court CR. MISC. No.31161 of 2023(2) dt.20-07-2023 2/2 per the FIR, it was co-accused Kranti Ram who stabbed Kundan Ram (deceased) with knife. There is no specific allegation of overt act against this petitioner. At best, petitioner is only alleged to be member of the mob. Petitioner claims clean antecedents.

Considering the facts aforesaid, the petitioner above-named, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga in connection with Town P.S. Case No. 253 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
