The petitioner apprehends his arrest in connection with Bairiya P.S. Case No. 04 of 2018, registered under Sections 304B, 201 and 120B of the Indian Penal Code, pending in the court of the Chief Judicial Magistrate, Bettiah West Champaran.

The accusation is of killing of the daughter of the informant by her husband and other in-laws due to nonfulfillment of demand of dowry and also due to illicit relation of husband of deceased with other lady.

Learned counsel appearing on behalf of the petitioner submits that, admittedly, the petitioner is the husband of the daughter of the informant, but daughter of the informant

Patna High Court Cr.Misc. No.50011 of 2018(2) dt.20-09-2018 2/2 died due to illness, but due to ulterior motive, the informant lodged this case with false allegation.

Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected.
