2. The petitioner apprehends his arrest in connection with Mansi P.S. Case No. 107 of 2023, instituted under Sections 447, 448, 323, 307, 354, 379, 427, 506/34 of the Indian Penal Code.
3. As per the prosecution case, on the date of occurrence petitioner along with F.I.R. named accused persons entered into the house of the informant and on the order of coaccused Deepak Kumar Vidyarthi, all the accused persons assaulted the informant and her sons causing injury on their head. Co-accused Nitish Kumar caught the informant with hair and torn her blouse and looted the house hold articles.
4. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.34343 of 2024(2) dt.21-06-2024 2/2 petitioner is innocent and has falsely been implicated in this case due to previous litigation between the parties. There is general and omnibus allegation. All the injuries of the injured are simple in nature. Petitioner has no criminal antecedent.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.
6. Considering the facts and circumstances of the case and submission of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria/ concerned Court in connection with Mansi P.S. Case No. 107 of 2023, subject to the conditions laid down in Section 438 (2) of the Code of Criminal Procedure, 1973.
