JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 27-06-2023 The grievance of the petitioner is that by the impugned letter/communication dated 26.04.2023 issued by the District Education Officer, Nawada to the Block Education Offier, Roh Block in the District of Nawada a direction has been issued to conduct the classes of the Higher Secondary School, Sundara in the building of Utkramit Madhya Vidyalaya, Marui, Roh on a wrong premise that the said school has got 75 decimal of land available and in the light of the departmental order contained in memo no.876 dated 07.06.2021 the building of the higher secondary school, Marui is to be constructed on the said land by the Bihar State Educational Infrastructure Development

Learned counsel submits that Marui Utkramit Madhya Vidyalaya has only two rooms remaining, it is wrongly stated in the letter that it has got 75 decimal of land. With reference to the letter no.689 dated 11.11.2022 written by the Circle Officer, Roh to District Education Officer, Nawada (Annexure- 'P7) learned counsel has shown to this Court that 75 decimal of land which has been identified for purpose of construction of the higher secondary school is comprising of plot no.2638 which is a 'Bandh'. It is submitted that the Circle Officer has recommended for construction of school building on the piece of land which comprises the said 'Bandh'. It is further submitted that from Annexure- 'P3') it would be clear that the Middle School, Marui is presently running on plot no.2102 which is only 24 decimal of land.

Considering the nature of the grievance of the petitioner, this Court deems it just and proper to direct the District Education Officer, Nawada to look into the grievance of the petitioner, consider the same, hear all the stakeholders and take an appropriate decision in the matter as early as possible preferably within a period of two months from the date of
