The petitioner seeks bail in Konch P.S. Case No. 245 of 2019, registered for the offence punishable punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2018. On secret information that this petitioner and other accused persons are indulged in manufacturing of liquor, a raid was conducted and 120 litres of country made liquor has been recovered from the bank of a river.
It is submitted that no recovery has been made from conscious possession of this petitioner. Recovery has been made from open place which is accessible to general public and petitioner has got no concern with the seized liquor. Petitioner
Patna High Court CR. MISC. No.40566 of 2021(2) dt.16-12-2021 2/2 is in custody since 09.03.2021. Investigation is complete. Considering the period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge IInd-cum-Special Judge (Excise Act), Gaya in connection with Konch P.S.
