The petitioner is in judicial custody in connection with Harsidhi P.S. Case No.168 of 2023 instituted under Sections 341, 342, 376-DA of the IPC and Sections 4 & 6 of the POCSO Act and Section 67(c) of the Information Technology Act lodged on 10.03.2023 by the informant.

As per the prosecution story, the girl has narrated about the rape committed by amongst other the petitioner herein. Based on her allegations, the FIR.

In this case, case diary was called for by earlier bench on 06.07.2023 which has since been received.

Learned APP took this Court to the statement made by

Patna High Court CR. MISC. No.31243 of 2023(3) dt.22-08-2023 2/2 the victim girl under Section 164 Cr.P.C. which completely supports the prosecution story and in that backdrop, no relief can be granted to the petitioner.
