This Civil Miscellaneous Application has been filed under Article 227 of the Constitution of India against the order dated 27.04.2016 in Title Suit No. 41 of 2016 passed by the learned Sub Judge 1st, Danapur whereby and whereunder the petition under Order 39 Rule 1 and 2 of the Code of Civil Procedure has been allowed and the Court has granted status quo till disposal of the suit.
3. Learned counsels for both the parties submit that this case may be disposed of with observation for early disposal of this case and both the parties shall cooperate the learned trial Court for early disposal of the Title Suit No. 41 of 2016 pending
Patna High Court C.Misc. No.220 of 2017(12) dt.22-08-2023 2/2 in the Court of learned Sub Judge 1st, Danapur / Successor Court.
4. In view of the submissions of learned counsels for the parties, this Civil Miscellaneous Application is disposed of with the direction to the learned trial Court to expedite the disposal of the aforesaid suit preferably within six months of this order.
5. Both the parties are directed to cooperate the learned trial Court for disposal of the suit within the said period. No unnecessary adjournment shall be given to any party in the suit.
6. This Civil Miscellaneous Application is, accordingly, disposed of with the aforesaid observation and direction.
