2. The petitioner is apprehending arrest in connection with LNMU P.S. Case No. 09 of 2025 registered on 24.01.2025 for the offences punishable under Sections 316(2), 316(5), 318(4), 3(5) of the BNS, 2023.
3. As per the prosecution, the petitioner is alleged to have embezzled a sum of 14,42,278/- during his tenure as ₹ Branch Credit Manager at Bharat Financial Inclusion Ltd.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.31502 of 2025(3) dt.23-07-2025 2/2 petitioner is innocent and has committed no offence. It is contended that he has been falsely implicated in the present case due to enmity and misunderstanding. Although the alleged occurrence took place between 10.06.2023 and 29.12.2023, the FIR has been lodged after an inordinate delay of more than seven months, based on a false and concocted narrative. In fact, the FIR was filed only after the petitioner served a legal notice upon the Manager of Bharat Financial Inclusion Ltd., demanding payment of his outstanding salary. It is further submitted that the petitioner has no criminal antecedents.
5. Learned APP for the State opposes the prayer for bail of the petitioner.
6. In this background, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner in connection with LNMU P.S. Case No. 09 of 2025, pending before the learned SDJM, Darbhanga is hereby rejected.
