JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-07-2019 This is an application for grant of anticipatory bail in connection with Angarghat P.S. Case No. 54 of 2009, disclosing offence under Section 392 of IPC.

Allegation as per F.I.R. is that while the informant was going by motorcycle, three unknown miscreants came ridding on motorcycle and snatched the motorcycle along with mobile phone. Petitioner is not named in the F.I.R. Submission of the learned counsel for the petitioner is that except confessional statement there is nothing against him. He has no criminal antecedent.

Heard learned A.P.P. also, who opposed the prayer for anticipatory bail on the ground that the impugned order itself shows that the motorcycle used in the commission of offence was recovered from the house of the petitioner and the case is

Patna High Court CR. MISC. No.31691 of 2019(2) dt.24-07-2019 2/2 still under investigation.

Having heard both sides, in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner. With the aforesaid, this application is dismissed. (Vinod Kumar Sinha, J) Sunil Shukla/- U T
