2. The petitioner apprehends his arrest in connection with Tariyani P.S. Case No. 09/2025 for the offences punishable under Sections 140(3)/3(5) of the BNS.

3. As per the prosecution case, on 04.01.2025, the father-in-law of the informant namely, Sridev Sahni was taken by the petitioner and co-accused Lal Vachan Sahni. It is alleged that when he did not return, the informant went to the house of the petitioner and enquired about the whereabouts of her fatherin-law then the petitioner along with others ousted her from their house. Subsequently, the dead body of the father-in-law of the informant was recovered.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case due to

Patna High Court CR. MISC. No.29445 of 2025(2) dt.08-05-2025 2/2 previous enmity. It is further submitted that F.I.R. has been lodged after five days of the missing of the deceased. The post mortem report indicates that death was caused due to drowning leading to pulmonary cardiac arrest.

Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail and submitted that there is specific accusation against the petitioner in the F.I.R. that he was last seen with the deceased along with co-accused Lal Vachan Sahni and subsequently, the dead body was found in the water.

6. Considering the facts and circumstances of the case and the nature of accusation levelled against the petitioner, this Court is not inclined to grant anticipatory bail to this petitioner. It is, accordingly, dismissed.
