2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 61(2), 3(5) of the Bharatiya Nyaya Sanhita and Section 30(a) of Bihar Prohibition and Excise Act.

3. As per prosecution case, 1098 liters illicit liquor was recovered from the spot.

4. Learned counsel for the petitioner submits that no incriminating material has been recovered from conscious possession of the petitioner. Recovery has been made from an open place, accessible to one and all. Petitioner has been made accused in this case only on suspicion.

5. Learned A.P.P. for the State opposes the prayer for bail and submits that the petitioner has got three criminal
