The petitioners apprehend their arrest in Aurangabad Town P.S. Case No. 189/2018, registered for the offences punishable under Sections 420, 406, 468, 471 and 34 of the Indian Penal Code.

On secret information, Ashutosh Memorial Hospital, Aurangabad was inspected by the Incharge Civil Surgeon and other officers. Two patients were operated, but no doctor was present there. In spite of waiting for sometime, no doctor came there. Dr. Ashutosh Kumar, M.D. Sadar Hospital, Aurangabad has certified that he performed operations in Ashutosh Memorial

It has been submitted that similarly situated two coaccused named in the F.I.R., have been granted anticipatory bail by this court.

Considering the facts aforesaid and the fact that similarly situated co-accused have been granted anticipatory bail by this court, the petitioners above-named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Aurangabad Town P.S. Case No. 189/2018, subject to the conditions:

(1.) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2.) Petitioners shall co-operate in the trial and shall be present on each and every date fixed by the court and their absence on two consecutive dates without proper and reasonable reason will be sufficient to

(3.) If the petitioners tamper with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioners.
