Mr.Choubey Jawahar ====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 06-05-2019 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in Lauriya P.S. Case No. 319/2018, instituted for offences under Section(s) 304 (B)/34 of the Indian Penal Code.

It is alleged in the written report that daughter of informant had performed love marriage with Ram Pravesh Sah on 02.05.2017. Aforesaid Ram Pravesh Sah was already married with one Priyanka. After marriage, daughter of informant was tortured in her Sasural for non-fulfillment of demand of dowry. It is alleged that on 04.10.2018, the informant got information that his daughter has been done to death.

Learned counsel for the petitioner has submitted that

Patna High Court CR. MISC. No.28819 of 2019(2) dt.06-05-2019 2/2 petitioner is mother-in-law of deceased. There is no allegation of specific overt act against this petitioner.

The other co-accused has already been granted bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 27197/2019 dated 25.04.2019.

Petitioner is in custody since 03.11.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st, West Champaran, Bettiah, in connection with Lauriya P.S. Case No. 319/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
