2. The petitioner seeks bail in a case registered for the offence punishable under Sections 333, 126(2), 115(2), 117(2), 109, 74, 3(5) of the B.N.S.
3. The case of the prosecution is that while the informant was sleeping with her daughter, some miscreants entered in the house and assaulted the daughter with the butt of gun causing injuries and her teeth was also broken. It has been alleged that two co-villagers Umesh Yadav and Manoj Yadav were seen wandering near her house and she also claims to identify the assailants.
4. Learned counsel for the petitioner submits that the petitioner is not named in the FIR and his name has surfaced in
Patna High Court CR. MISC. No.30138 of 2025(3) dt.29-05-2025 2/3 this case only on the basis of suspicion. It is further submitted that despite the informant's claim to identify the miscreants, till date no Test Identification Parade has been conducted in this case and further from the perusal of the FIR, it would be clear that there is no direct allegation against the petitioner. The petitioner is in custody since 21.01.2025. Although, it has been noted in the bail rejection order that the injury suffered by the informant's daughter is grievous while the injury of the informant is simple in nature caused by hard and blunt substance, it is submitted that the petitioner is not the author of the injuries and moreover charge-sheet has been submitted against him. The petitioner has no criminal antecedent and the attention of this Court has been drawn to an order dated 20.05.2025 passed in Cr. Misc. No. 30698 of 2025 whereby coaccused Prakash Yadav who is similarly situated to the petitioner has been granted bail despite criminal antecedent.
5. Learned APP for the State has opposed the application for bail.
6. Taking into consideration that the petitioner is in custody since 21.01.2025, the charge-sheet has been submitted and the petitioner who is a person aged about 65 years with no criminal antecedent, let the above named
Patna High Court CR. MISC. No.30138 of 2025(3) dt.29-05-2025 3/3 petitioner, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Jhajha P.S. Case No. 526 of 2024.
