Heard learned counsel for the petitioner. No one appears on behalf of the State, although the name of Advocate General appears in the cause list.

The petitioner is in custody in connection with Laheriasarai P.S. Case No. 616 of 2018 for the offence under Sections 341, 324, 326, 307/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the scuffle took place between the parties and both sides sustained injury, leading to lodging of case and counter case. The petitioner is in custody since 18.07.2019.

Considering the fact that there is case and counter
