JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Panapur P.S. Case No. 156 of 2017 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 379, 504 and 506 of the Indian Penal Code. Allegation against the petitioner is of assaulting by means of sword to the nephew of the informant and causing injury to him.

Submission of learned counsel for the petitioner is that in this case police has submitted final form against the petitioner not finding the case true but learned Magistrate has taken cognizance against him and FIR itself shows that scuffle took place due to some petty dispute.

Heard learned APP, who has opposed the prayer for anticipatory bail on the ground that there is specific allegation

Patna High Court CR. MISC. No.29906 of 2019(4) dt.13-09-2019 2/2 against the petitioner of causing grievous injury on the back of the injured.

In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. He may surrender and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order.

With the above observation, this application is dismissed.
