The petitioner is in custody in connection with Harsidhi P.S. Case No.62 of 2019 for the offences under Sections 341, 323, 324, 325, 308, 379, 354, 427, 504, 34 of the Indian Penal Code.

Allegation against the petitioner is that he has assaulted the informant with Farsa.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 19.02.2019. Learned counsel further submits that there is no repeat blow and as such, no offence under Section 308 of IPC is made out.

Considering the fact that the petitioner has no criminal

Case No.62 of 2019.
