2. The petitioner is named in the F.I.R. and apprehending his arrest in connection with Kuchaikote P.S. Case No. 116 of 2025 registered for the offences punishable under Sections 303(2), 318(2), 111(2) BNS.
3. As per FIR petitioner alleged to cheat informant for sum of Rs. 7,500/- while he was withdrawing the amount from ATM.
4. It is submitted by learned counsel appearing on behalf of the petitioner that the allegation against petitioner is very much general and omnibus in nature and, moreover, the petitioner was alleged to disturb the ATM machine only after leaving the place by informant. It is further urged that there is no any such allegations which may suggest that the informant was induced to deliver any property or was deceived by petitioner. It
Patna High Court CR. MISC. No.29981 of 2026(2) dt.11-05-2026 2/2 is submitted that petitioner found involved in one more criminal case of different nature where he is on bail. While concluding argument, it is submitted that matter in issue now compromised with informant in terms of Annexure-P/2.
5. Learned APP opposes the prayer of bail.

In view of aforesaid factual submission and by taking note of fact as prima-facie allegation is not satisfying the basic ingredients of cheating rather alleging petitioner to disturb the ATM machine only, coupled with the fact that issue also appears compromised between the parties, accordingly petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks, is directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Gopalganj/concerned Court, where the case is pending in connection with Kuchaikote P.S. Case No. 116 of 2025, subject to the conditions as laid down under Section 482(2) of BNSS.
