JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-05-2019 Petitioner seeks regular bail in connection with Haveli Kharagpur P.S. (Shampur O.P.) Case No.65 of 2018 registered for the offences punishable under Sections 420, 419, 467, 468, 471 and 120 B of the Indian Penal Code. Allegation as per F.I.R. against the petitioner is that informant has got a Khatiyani land and he is in joint possession of the said land and some miscreants came there and tried to take forcible possession of the said land. One Subodh Singh has transferred the land to Rinku Devi, Meghi Devi, Gopi Mandal, Anjani Kumari, Dinesh Mandal (petitioner) and Rinku Devi by executing sale deeds on 01.09.2017.

Submission of the learned counsel for the petitioner is that the informant is stranger to the family of Khatiyani Raiyat and he has also filed a title suit bearing Title Suit No.85 of 2018

Patna High Court CR. MISC. No.33195 of 2019(2) dt.20-05-2019 2/2 in the Court of Sub Judge, 1st Munger. Further submission is that petitioner is purchaser only and he is in custody for more than five months.

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M.-IV, Munger, in connection with Haveli Kharagpur P.S. (Shampur O.P.) Case No.65 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
