JUSTICE ASHUTOSH KUMAR ORAL ORDER 22-11-2019 The petitioner seeks quashing of the order dated 31.10.2014 passed by the learned Judicial Magistrate, 1st Class, Gaya in connection with Complaint Case No. 1697/2013/T.R. No. 3609/2014 whereby cognizance has been taken under Section 138 of the Negotiable Instrument Act.

No good ground has been made out by the petitioner to warrant any interference with the order taking cognizance. Whatever presumption the petitioner would like to rebut, he would have ample opportunities before the court below.

The petition has no merits and the same is

The dismissal of the present petition would not be read to be prejudice of the petitioner in case he participates in the trial.
