Counsel for the petitioner submits that due to rejection of candidature of Manoj Kumar Dubey in June 2017 vacancy has occurred. He submits that he was a participant in the process of selection for making appointment of Primary Health Worker on contractual basis and was at Serial No. 4 in the merit list published pursuant to the selection process 15.2.2016 and 16.2.2016, he would be entitled to be considered for engagement on contractual basis being next in the merit panel.

Without expressing any opinion on merits of the submission made by Counsel for the petitioner and since it is
