2. The petitioner is in custody in connection with Bhagwanpur P.S Case No. 87 of 2024 registered for the offences punishable under Sections 399, 400, 402 of I.P.C and 25 (1-B) (a); 26 & 35 of the Arms Act 1959.

3. As per prosecution case, arms and ammunition were recovered from the conscious possession of the petitioner.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is further submitted that during investigation police has not recorded the statement of any of independent witness. It is also submitted that petitioner is in judicial custody since 01.04.2024.

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

6. On perusal of the FIR and impugned order, it appears that a country made pistol loaded with the bullet and a bullet was recovered from the petitioner besides this no any other incriminating articles have been recovered from the conscious possession of the petitioner. Petitioner is in custody since 01.04.2024 and he has got two criminal antecedents as stated in paragraph-3 of the bail application.

Considering the aforesaid facts and circumstances of the case and submissions made on behalf of the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned District and Sessions Judge-VIII, Begusarai, Bihar in connection with Bhagwanpur P.S Case No. 87 of 2024.
