====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 02-03-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offences punishable under Sections 147/341/323/354/ 379 /307 / 448/504/506 of the Indian Penal Code. Later on offence under Section 302 of the Indian Penal Code was added. The FIR discloses that the petitioner is neighbour of the informant. The tree of the petitioner fell at the gate of the informant in the night of 07.08.2019. When the informant asked the petitioner to remove the tree to avoid obstruction and inconvenience; the petitioner denied and thereafter the petitioner and other family members including female inmates of the house of the petitioner variously armed entered into the house of the informant. Patna High Court CR. MISC. No.30272 of 2020(4) dt.02-03-2021 2/2 of Uma Shankar Pandey as a result whereof Uma Shankar Pandey died. The injured died on 15.08.2019 and the post mortem report would reveal that the doctor found two abrasions, one at nose and another at the forehead and one bruise at the temporal parietal region and the cause of death was intracranial haemorrhage. Considering the material aforesaid, period already undergone by the petitioner and completion of investigation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Rajauli P.S. Case No.282 of 2019, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
