2. The petitioner has preferred this application for grant of regular bail in connection with Baikunthpur P.S. Case No. 244 of 2022 registered for the offences punishable u/s 395 of the I.P.C. and Section 27 of the Arms Act.

3. As per the prosecution case, On 17.08.2022 at about 8:30 A.M., six miscreants armed with fire arms came to the C.S.P. Center and committed a loot and they took Rs. 5,30,000/- from the counter of the C.S.P. Center and also took away mobiles from the possession of the informant's uncle.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

It is further submitted that the petitioner is not named in the FIR and no TIP has been conducted in order to verify the identification of the petitioner. It is next submitted that no incriminating material has been recovered from the conscious possession of the petitioner. Learned counsel for the petitioner has further submitted that four co-accused persons, namely, Rampravesh Yadav, Satyendra Yadav, Dilip Yadav and Bablu Yadav have been granted bail by the Co-ordinate Bench of this Court vide Cr. Misc. No. 18916 of 2023, Cr. Misc, No. 13416 of 2023, Cr. Misc. No. 41668 of 2023 and Cr. Misc. No. 77243 of 2023 vide order dated 18.05.2023, dated 19.06.2023, dated 14.07.2023 dated 06.12.2023. It is lastly submitted that the petitioner has three criminal antecedents and is in custody since 30.09.2023.

Learned A.P.P. for the State has vehemently opposed the prayer for bail and submitted that the name of the petitioner has transpired in this case on the basis of confessional statement of the co-accused Dilip Yadav and he is directly involved in the said loot, hence, he should not be granted the liberty of bail.

6. Considering the aforesaid facts and circumstances

Patna High Court CR. MISC. No.36142 of 2024(9) dt.16-04-2025 3/3 of the case, let the petitioner above-named, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Gopalganj, in connection with Baikunthpur P.S. Case No. 244 of 2022.

7. The application stands allowed.
